The Securities Act 2005 and the regulations issued under it permit the establishment and licensing of Investment Advisor Companies in Mauritius. Mauritius offers a modern and flexible securities regulatory framework, provides clear Investment Advisor licensing within a reasonable timeframe, requires moderate minimum capital, charges competitive licence fees, and maintains a relatively low tax rate. Under the Securities Act, there are two main categories of Investment Advisors:
Investment Advisor — Unrestricted Licence
Authorised to manage securities portfolios under a mandate and to provide advice on securities transactions through printed materials or any other medium.
Investment Advisor — Restricted Licence
Authorised to provide advice on securities transactions through printed materials or any other medium only.
FINANCIAL STATEMENTS FILING
All categories must submit audited financial statements within three months after the end of the financial year.
STAFF QUALIFICATIONS
Employees must possess the relevant qualifications and experience as required under the Securities Act.
MINIMUM CAPITAL REQUIREMENT
Each category of Investment Advisor must maintain the minimum capital requirement specified for its licence category.
